Berkshire School is committed to protecting the privacy of its community. Below is the policy for our website at www.berkshireschool.org.

Personal Information
We do not sell, rent or trade personal information to third parties. Personal information is any information that could reasonably be used to identify you, including your name, address, email address, social security number, birth date, financial account information, credit card, or any combination of information that could be used for identification purposes. We do not collect personal information unless you voluntarily provide it by sending us an email, participating in a survey, completing an online form, or providing account information. We may utilize agents, contractors and/or service providers for data collection storage purposes or to assist with other operations. The School may also be compelled to release personal information in response to a valid subpoena, court order or other legal process.

Consent
Where consent for the use and disclosure of personal information is required, the School will seek consent from the appropriate person. In case of a student’s personal information, the School will seek the consent from the student and/or parent depending on the circumstances and the student’s maturity to understand the consequences of the proposed use and disclosure. Berkshire School complies with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which prohibits requesting personal information from anyone under the age of 13 without requesting verifiable parental consent.

Cookies
A cookie is a small text file stored by your browser that allows the website to “remember” your preferences such as calendar settings, font size and site bookmarks on the site from visit to visit, or to maintain your “logged-in” status when visiting protected areas. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Web browsers have settings allowing you to reject cookies, or selectively accept cookies, or delete cookies previously accepted. Please be aware that rejecting or deleting cookies from our website may make certain function unavailable to you.

Use of Tracking Technologies and Google Analytics
We use tracking technologies, specifically Google Analytics, to collect information about how visitors interact with our website. This tool collects data such as how often users visit the site, what pages they visit, and what other sites they used prior to coming here. We use the information we get from Google Analytics solely for the purpose of monitoring and improving user engagement, optimizing website performance, and enhancing your overall browsing experience. When you visit a page with an embedded Vimeo player, or click to play an embedded video, the third-party platform may drop essential or non-essential cookies (such as the vuid cookie) and utilize scripts to track viewer interaction, analyze player performance, and gather session analytics. All data collection, processing, and storage initiated through the video player are governed entirely by Vimeo’s independent Privacy Policy and Cookie Policy. Our organization does not control, harvest, or have access to the specific behavioral tracking profiles generated by these interactions.

While our organization endeavors to select reliable partners, all third-party media integrations operate within an external software ecosystem beyond our direct administrative control. Our organization explicitly disclaims any and all liability for automated tracking actions, data retention practices, or algorithmic profiling executed independently by external platforms (like Vimeo or Google). This includes tracking activity amplified by a user’s personal browser configurations, or tracking that occurs because a user remains actively logged into a personal Google, Vimeo, or social media account while browsing our website.

Do Not Track (DNT)
“Do not track" settings are signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer's on-line activities over time and across third-party websites or online services. The School currently does not honor the "do not track" signals. Further, third parties engaging in online behavioral tracking for a variety of purposes may or may not collect personally identifiable information related to consumers' online activities over time and across different websites through the School's website.

Do Not Sell
Under certain state regulations (such as the California Consumer Privacy Act/CPRA), the terms "sell" and "share" are broadly defined to include the transfer of website visitor data to third parties for commercial advertising or analytics purposes. Our school does not rent, sell, trade, or lease any personal data, student records, or visitor information to third parties for monetary compensation or profit. We do not share website visitor data with third-party networks for the purpose of cross-context behavioral advertising (targeted marketing across different apps or websites). Any data transmitted via our website integrations (such as Google Analytics or Vimeo video players) is strictly constrained to operational performance, site optimization, and content delivery. Because our organization does not engage in the sale or sharing of personal data as defined by law, a "Do Not Sell or Share My Personal Information" link is not provided on our platform.
